**Scooters Near You – Terms of Service** Website: [https://scootersnearyou.com](https://scootersnearyou.com) ([scootersnearyou.com][1]) These Terms of Service (“Terms”) govern the rental of mobility scooters, electric wheelchairs, strollers, and related accessories (collectively, “Equipment”) by Calter LV LLC DBA Scooters Near You (“Company,” “we,” or “us”) to the person signing this agreement (“Renter,” “you,” or “your”). By signing below or completing a booking, you agree to all provisions herein. --- **Ownership and Condition** All Equipment remains the sole property of the Company. Equipment is delivered clean, charged, and in good working order. You agree to return it in the same condition (ordinary wear and tear excepted) at the end of the rental period or sooner upon our request. **Personal Property Liability** The Company is not responsible for any personal items lost, damaged, stolen, or stored in or on the Equipment. You assume all risk and waive any claims against the Company for such loss or damage. You will indemnify, defend, and hold the Company harmless from all claims arising from personal property loss or damage. **Liability Waiver & Arbitration** You waive any right to sue the Company for injuries, losses, or claims arising from rental or use of the Equipment. All disputes will be resolved by binding arbitration, with each party bearing its own costs. **Exclusive Use & Non-Transferability** Only you, the Renter who signs this agreement, may operate or permit use of the Equipment during the rental period; any unauthorized use is prohibited. **Operators & Riders** * **Primary Renter Age:** The person signing this agreement must be at least **18 years old**. * **Minor Usage:** Minors (under 18) may operate or ride the Equipment **only** under the **direct supervision** of the Renter. The Renter acknowledges that any use by a minor is at the Renter’s **sole risk and responsibility**, and Renter **indemnifies and holds Company harmless** from any claims arising from such use. **Manufacturer Defects** The Company is not the manufacturer and cannot be held liable for defects or malfunctions arising from manufacturing or design. You agree to pursue any claims against the manufacturer directly. Notify us immediately of suspected defects; we will assist in coordinating any manufacturer resolution. **Equipment Damage, Loss & Theft** 1. **Renter Responsibility:** You are responsible for all repair or replacement costs if Equipment is damaged, lost, stolen, or destroyed. 2. **Notification:** Report any defect, accident, damage, or theft within **two hours** of occurrence. We will document costs and charge your payment method on file or send an invoice as described below. 3. **Invoices & Collections:** * **With Card on File:** Charges for damage or loss will be processed automatically against the card on file. * **Without Card on File:** We will issue an invoice for the full repair or replacement cost, due **immediately**. Any unpaid balance **over 48 hours** from the invoice date will be forwarded to collections or pursued in small-claims court, in compliance with Nevada law. 4. **Downtime Fees:** If Equipment is out of service awaiting repair or replacement, you agree to pay a daily **downtime fee** equal to our standard daily rental rate for each day (or partial day) the Equipment is unavailable. 5. **Rental-Blocking Fees:** If failure to pay or replace Equipment prevents us from renting that unit to another customer, you will also be charged a fee equal to the standard daily rental rate for each day until the Equipment is returned or replaced. **Operation Restrictions** Operate Equipment with reasonable care and in compliance with all local laws and ordinances. No second riders, no calls/texting while operating, and no off-road use. You indemnify and hold us harmless from any liability arising from your operation of the Equipment, except in cases of our gross negligence. **Third-Party Equipment** If our inventory is **sold out** or your requested model is unavailable, we may fulfill your order through **third-party providers** (“Partners”). Partner-provided Equipment **may include** three-wheel or four-wheel scooters, electric wheelchairs, or similar devices. Unless you **explicitly request** a specific model or wheel-count at the time of booking, we will deliver **whatever Partner Equipment is available**. **We assume no liability** for the performance, condition, or safety of Partner-provided Equipment; all other Terms (damage, loss, theft, etc.) apply to such rentals. **Payment & Identification** We accept major credit cards (Visa, MasterCard, Discover, American Express). A valid government-issued photo ID matching the cardholder is required at delivery. Debit cards may be used for rental charges only; prepaid cards, checks, money orders, and cash are **not** accepted. **Security Deposit** No deposit is required if valid matching ID is provided. Otherwise, a refundable **\$200** deposit is required, returned upon timely and undamaged return of Equipment. **Cancellation & No-Show** * Cancellations **≥ 14 days** before delivery: **full refund**. * Cancellations **7–13 days** before delivery: **50% refund**. * Cancellations **< 7 days** before delivery or no-shows: **no refund**. **Late Delivery Guarantee** If delivery is delayed by **more than 1 hour**, you receive a **50% refund** for that rental day. **Protection Plans** * **Basic Plan** (\$5/day): covers equipment damage (excludes keys, chargers, baskets); \$250 deductible. * **Plus Plan** (\$10/day): covers damage and theft; \$250 deductible (damage), \$500 deductible (theft; police report required). **Extensions & Returns** To extend your rental, call before the scheduled return time; approval is at our discretion. Unapproved extensions incur **\$50 per additional day** (or fraction thereof). Drivers will wait **10 minutes** past the scheduled pickup time; a \$40 return-trip fee applies thereafter. **Battery, Key & Re-Delivery Fees** Equipment is delivered fully charged; you must recharge as needed. * Dead-battery re-delivery: \$50 (business hours) / \$75 (off hours). * Lost key: \$50 replacement fee. * Failure to return with a charged battery (8 AM–11 AM): \$50 fee. **Tracking & Data** GPS tracking devices monitor Equipment location for safety. Data may be shared with law enforcement or insurers if required. **User Responsibilities** Read and follow all provided manuals, instructions, and videos. You are liable for any costs resulting from failure to comply with operational or charging instructions. **Fraudulent Chargebacks** We reserve the right to pursue legal action or collections for chargebacks initiated without prior dispute resolution. **SMS Terms** Up to 5 SMS messages per month for service updates or promotions; standard messaging rates apply.
